With Ukraine's funds dwindling, the £184bn worth of Russian assets that remain frozen across Europe, especially in Belgium, present an obvious solution. Mobilizing these funds for Ukraine is seen by many as the execution of a clear obligation, a powerful demonstration that Europe is capable of heavyweight action.

Navigating the Messy Real World of Law and Politics

In the complex arena of practical geopolitics, however, the situation has been anything but simple. Legal considerations, market realities, and bitter politics have become entangled, with considerable acrimony, into the buildup to the Brussels meeting. Imposing reparations can carry dangerous diplomatic repercussions. Asset forfeiture will inevitably encounter robust legal opposition. Critically, it is fiercely contested by the former US president, who aims for the unfreezing of assets as a central plank of his diplomatic roadmap. Mr. Trump is campaigning hard for a rapid deal, with US and Russian negotiators set to reconvene in Miami imminently.

The EU's Complex Loan Proposal

The European Union has striven hard to craft a financial package for Ukraine that harnesses the frozen capital without simply handing over them to Kyiv. Their loan proposal is seen by supporters as clever and, for those who champion it, both within the bounds of law and crucially important. It will never be viewed in the Kremlin or the White House. A number of European nations held out against it as discussions commenced. Belgium, notably, was on a knife-edge. International bond markets might downgrade states that take on part of the inherent risk. At the same time, citizens across Europe enduring cost of living pressures may recoil at such massive expenditures.

Global Precedents and Long-Term Dangers

What global signal might be set by such a move? The hard reality is that this is dictated by the conclusion on the military front and in diplomatic chambers. It must be remembered: an extended period of economic penalties have not crippled the Moscow's financial system, thanks in large part to robust hydrocarbon trade to the likes of China and India.

The strategic legacy matter greatly as well. Should the funding proceed but proves insufficient to turn the tide, it could make it far harder for Europe's ability to assert ethical leadership in coming confrontations, like a potential Taiwan scenario. Europe's well-intentioned move at solidarity might, in fact, end by opening a dangerous new era of unabashed economic nationalism. Simple solutions are absent in this high-stakes arena.

Why This Summit Matters So Much

The potency of these dilemmas, plus a multitude of additional thorny problems, illuminates three major points. First, it demonstrates why this week's European summit, extending into Friday, is of paramount concern for Ukraine. Second, it underscores why the meeting is at least as important, though in a separate strategic sense, for the future trajectory of the European Union. Third, and as might be expected, it accounts for why agreement was not reached in Brussels during the opening sessions of the summit.

The paramount reality, however, is a truth that holds firm whatever the conclusion reached. If the west does not leverage the immobilized capital, the West cannot continue to finance a war heading into its fifth year. It is precisely why, on multiple levels, this constitutes the moment of truth.
